The Florida Trial Attorney provides legal representation, either personally or by retaining and supervising outside counsel that handles moderately complex litigation involving either us or our insured within established corporate guidelines and the applicable code of professional responsibility. Litigation includes all aspects of civil litigation, including trials and proceedings in all forums, whether at the local, state or federal level, mediation, arbitration, workers' compensation, and administrative proceedings, and any necessary appellate work. You will provide legal advice to assist the disposition of claims in a fair manner consistent with relevant statutes and within the guidelines of the company. You will report to the Legal Manager.
Primary Accountabilities
- You will handle litigation involving either us and our insured within established corporate guidelines and the applicable code of professional responsibility.
- You will analyze the file as litigation progresses. You will analyze risk to insured and us and evaluate cases and seek settlement.
- You will conduct discovery (e.g. written interrogatories, requests for production of documents, and depositions).
- You will conduct motion practice.
- You will draft all necessary pleadings, papers and briefs to advance litigation activities at the trial or appellate level.
- You will conduct necessary legal research.
- You will advocate client position in all forums (state and federal court, alternative dispute resolution, administrative tribunals and regulatory hearings) and circumstances.
- You will stay current on state statutes and court decisions and analyzes how statutes and court decisions affect the interpretation and enforceability of the policy provisions.
Qualifications:
- This is a remote position.
- Three (3)+ years of insurance defense litigation experience
- Trial experience
- Able to handle full-time high volume case load
- Prior experience in a claims department or staff counsel organization beneficial
- Insurance defense background, with specific experience in personal lines and commercial (auto and premises)
- Insurance defense background in construction defect beneficial
- Must be licensed to practice law in State of Florida
Locations for this role include Orlando, Jacksonville, Miami or Tampa.
