This Policy applies to Jobstore Australia Pty Ltd (ACN 619 238 961) (referred to as 'Jobstore', 'we', 'our', 'us') and extends to and covers
all operations and functions of those organisations.
All third parties (including clients, suppliers, sub-contractors, or agents) that have access to or use personal information collected and held
by Jobstore must abide by this Privacy Policy. Jobstore makes this Policy available free of charge and can be downloaded from its website
https://www.jobstore.com/au.
This Policy outlines Jobstore's obligations to manage and protect personal information. Jobstore is bound by the Australian Privacy Principles ('APPs')
and the Privacy Act 1988 ('Privacy Act'). This Policy also outlines Jobstore's practices, procedures and systems that ensure compliance with
the Privacy Act, the APPs and the Notifiable Data Breaches ('NDB') scheme.
The use of the Website entails various types of personal information being provided for various purposes.
In this Privacy Policy:

'Credit information' is personal information (other than sensitive information) that relates to an individual's credit history or credit worthiness,
and is further defined in the Privacy Act. Credit information includes information that the company has obtained from third parties, including
individuals, other credit providers and credit reporting bodies ('CRBs');

'Disclosing' information means providing information to persons outside Jobstore;

'Individual' means any persons whose personal information Jobstore collects, uses or discloses, either as a representative of a User or an Investor or otherwise;

'Personal information' means information or an opinion relating to an individual, which can be used to identify that individual;

'Privacy Officer' means the contact person within Jobstore for questions or complaints regarding Jobstore's handling of personal information;

'Sensitive information' is personal information that includes information relating to a person's racial or ethnic origin, political opinions,
religion, trade union or other professional or trade association membership, sexual preferences and criminal record, and also includes health information;

'Use' of information means use of information within Jobstore;

'User' means a person or entity that has created a user account with Jobstore; and
-
'Website' means the interactive business networking and educational platform at www.jobstore.com/au.
By accessing the Website and creating a user account with Jobstore, Individuals and Users agree and consent to Jobstore, its related bodies corporate,
and successors and assignees collecting, using, disclosing and sharing amongst themselves personal information, and disclosing the Individual's
personal information to and relevant third party service providers in accordance with the Privacy Policy.
1. COLLECTION OF PERSONAL DATA
1.1
Users may browse the Website anonymously. However, Users will have to create a user account in order to sign-up as job seeker or receive more information regarding the job advertisements on the Website.
1.2
When creating a user account with Jobstore, Users consent to provide their personal data, including but not limited to:

occupation;
1.2.5
any other information that is relevant to the services we provide.
1.3
Jobstore may collect an Individual's personal information by the following methods:
1.3.1
directly from applications, questionnaires and other forms the Individual completes when they wish to use Jobstore's services;
1.3.2
from information disclosed to Jobstore by the Individual on the phone, or by sending correspondence (including letters, faxes and emails) to Jobstore;
1.3.3
from a variety of third party sources, including Jobstore's business contacts, identity verification service providers, financial institutions, or referrers; or
1.3.4
from information disclosed by the Individual when creating a user account using social media credentials as provided for on the Website from time to time. In doing so, Users consent to Jobstore collecting personal data that may be available through such social media networks, including but not limited to Facebook.
1.4
In some circumstances Jobstore may be provided with personal information about Individuals from a third party. When this occurs, Jobstore will take reasonable steps to ensure that the User is or has been made aware of the matters set out in this Privacy Policy. The User may also appoint Jobstore as its agent to obtain credit information about them from a credit reporting body or credit provider, to assist Jobstore in providing its services to them.
1.5
Jobstore will not collect sensitive information unless the Individual has consented or an exemption under the APPs applies. These exceptions include if the collection is required or authorised by law or necessary to take appropriate action in relation to suspected unlawful activity or serious misconduct.
1.6
Jobstore may also collect and use information about your job seeking needs, characteristics and priorities by collecting and analysing data about how you use, or interact with, the products and services offered on the site. Jobstore may use this information, including through automated processes applying algorithms, for the purposes set-out in this Privacy Policy, including without limitation to better tailor Jobstore's offerings to your job seeking needs and to provide more targeted services to Employers and to Job Seekers.
1.7
If the personal information Jobstore requests is not provided by an Individual, Jobstore may not be able to provide the Individual with the benefit of its services.
1.8
Jobstore does not give Individuals the option of dealing with it anonymously, or under a pseudonym. This is because it is impractical and in some circumstances illegal, for Jobstore to deal with Individuals who are not identified.
1.9
If Users provide Jobstore with any personal information relating to a third party, by submitting such information to Jobstore, Users represent to Jobstore that they have obtained the consent of the third party to provide Jobstore with such personal information for the purposes stated in paragraph 5.
1.10
Users shall ensure that all personal information submitted to Jobstore is complete and accurate. Any omission or failure to do so may prevent Jobstore from providing the User with its services.
2. ONLINE JOB APPLICATIONS
Making an online job application to a job advertisement on Jobstore is a free and optional service that requires Job Seeker to complete mandatory fields (for example first name, last name, gender, age, address, contact number and email) so that the Employer can identify and contact the Job Seeker. When first applying for the a job, Job Seekers who do not have a Jobstore Profile will also be required to create a Jobstore Profile based on the information contained in their application, and you may subsequently edit your Jobstore Profile.
When you apply for a job advertisement on our website, applications including cover letters and attachments are forwarded directly to the Employer and/or its nominated representative.
Some Employers may also require you to answer a list of questions selected by that Employer as part of your online application. By answering the application questions you acknowledge that Jobstore will provide your answers to that Employer and may use your answers to populate your Jobstore Profile and enable Employer to access that information when using Talent Search. Jobstore may also use your answers to improve our products, including through improving our search and matching capabilities.
3. EMPLOYERS
Jobstore collects the company name, business address and billing address of Advertisers. It also collects the name, email address and contact number of a primary contact. Employers can choose to add additional users to their account, in which case Jobstore will collect the name, email address and contact number of those other users. Employers can change the company name, contact number, billing address and other details at their own Employer's account signed-up with Jobstore, under the Company Information page.
4. COOKIES
4.1
Cookies are small files that a website or service provider transfers to computer hard drives through a web browser that enables the website or service provider's systems to recognize the browser and record certain information.
4.2
Jobstore uses cookies on the Website to record Users' usage patterns and trends and customize User experience. Jobstore may engage third party service providers to assist in such purposes. However, such third party service providers may not disclose personal information obtained in the course of their engagement to any other parties.
4.3
Users may disable the processing of cookies on their web browsers but this may prevent Users from maximising the services provided by Jobstore.
5. USE OF PERSONAL INFORMATION
Jobstore uses personal information collected from Individuals for the following purposes:
5.1
to assist Jobstore to provide Users and Individuals with its services;
5.2
to personalise User experience and respond to individual needs;
5.3
to improve and receive feedback on the Website;
5.4
to improve customer service and provide support services, including to consider any concerns or complaints that an Individual or User may have;
5.5
to send periodic direct marketing emails, including but not limited to news, updates and related information;
5.6
to invite Users and Individuals to marketing events;
5.7
to manage any legal actions concerning Jobstore;
5.8
to comply with relevant laws, regulations and other legal obligations; and
5.9
to help Jobstore to improve its services, and to enhance its overall business.
6. DISCLOSURE OF PERSONAL INFORMATION
6.1
Jobstore may use and disclose personal information for the primary purposes for which it is collected, for reasonably expected secondary purposes which are related to the primary purpose and in other circumstances authorised by the Privacy Act.
6.2
Jobstore uses and discloses personal information (excluding credit information) for the purposes outlined in section 5 above. Sensitive information will be used and disclosed only for the purpose for which it was provided or a directly related secondary purpose, unless the individual agrees otherwise, or where certain other limited circumstances apply (e.g. if required by law).
6.3
Jobstore may disclose personal information to:
6.3.1
a related entity of Jobstore;
6.3.2
an agent, contractor or service provider Jobstore engages to carry out its functions and activities, such as lawyers, accountants, debt collectors or other advisers;
6.3.3
organisations involved in a transfer or sale of all or part of the Jobstore business;
6.3.4
organisations involved in managing payments, including payment merchants and other financial institutions such as banks;
6.3.5
regulatory bodies, government agencies, law enforcement bodies and courts;
6.3.6
credit providers; and
6.3.7
anyone else to whom the Individual authorises Jobstore to disclose it or as required by law.
6.4
Jobstore engages other people to perform services on its behalf from time to time. Such services may involve that person handling personal information we hold. In these situations, Jobstore prohibits that person from using personal information about Individuals except for the specific purpose for which it is supplied. Jobstore prohibits that person from using the personal information for the purposes of direct marketing their products or services.
6.5
Jobstore may also collect personal information from third parties, and will deal with that information in accordance with this Policy.
7. MANAGEMENT OF PERSONAL INFORMATION
7.1
Jobstore recognises how important the security of personal information is to Users. Jobstore will at all times seek to ensure that the personal information it collects and holds is protected from inference, misuse or loss, and unauthorised access, modification or disclosure. Jobstore's employees must respect the confidentiality of the personal information Jobstore collects.
7.2
Jobstore employs security measures to protect personal data.
7.2.1
All personal information collected on the Website is transmitted via Secure Socket Layer (SSL) technology and then encrypted into the gateway provider's database only to be accessible by those authorized with special access rights who are required to keep the personal data confidential.
7.2.2
No personal information is stored on the server.
7.3
Jobstore performs all employment procedures, including application and termination processes, in a confidential manner. All individual job attributes, such as classification information and salaries, are confidential.
7.4
Where Jobstore no longer requires personal information for a permitted purpose under the APPs, it will take reasonable steps to destroy or de-identify it.
7.5
In accordance with the NDB scheme, Jobstore is committed to its own data breach response plan. Jobstore will notify individuals and the Office of the Australian Information Commissioner when it is required to under the NDB scheme.
8. SENDING INFORMATION OVERSEAS
8.1
We may disclose personal information to related body corporates that are located outside Australia in some circumstances. These recipients may be located in the following countries:

Malaysia;

Singapore; and
-
other countries in Asia Pacific region.
8.2
Jobstore will not send personal information to recipients outside of Australia unless:
8.2.1
Jobstore has taken reasonable steps to ensure that the recipient does not breach the Privacy Act, the APPs and the Credit Reporting Privacy Code;
8.2.2
the recipient is subject to an information privacy scheme similar to the Privacy Act; or
8.2.3
the Individual has consented to the disclosure.
9. DIRECT MARKETING
9.1
Jobstore will not send personal information to recipients outside of Australia unless:
9.1.1
the personal information does not include sensitive information;
9.1.2
the Individual would reasonably expect Jobstore to use or disclose the information for the purpose of direct marketing;
9.1.3
Jobstore provides a simple way of opting out of direct marketing; and
9.1.4
the Individual has not requested to opt out of receiving direct marketing from Jobstore.
9.2
If the Individual would not reasonably expect Jobstore to use or disclose the information for the purpose of direct marketing, Jobstore may only use or disclose that information for direct marketing if the Individual has consented to the use or disclosure of the information for direct marketing or it is impracticable to obtain that consent.
9.3
In relation to sensitive information, Jobstore may only use or disclose sensitive information about an individual for the purpose of direct marketing if the Individual has consented to the use or disclosure of the information for that purpose.
9.4
The Individual has the right to request to opt out of direct marketing and Jobstore must give effect to the request within a reasonable period of time.
9.5
The Individual may also request that Jobstore provides them with the source of the Individual's information. If such a request is made, Jobstore must notify the Individual of the source of the information free of charge within a reasonable period of time.
10. THIRD PARTY WEBSITES
Jobstore shall not be responsible for the collection, use, disclosure and care of personal data by any third party websites linked to the Website.
11. WITHDRAWAL OF CONSENT
11.1
Users and/or Individuals may contact Jobstore at
admin@jobstore.com to withdraw their consent to the use of personal information by Jobstore, following which Jobstore shall cease to further collect, use and disclose personal information of that User or Individual.
11.2
Users and Individuals should be aware that the withdrawal of consent may prevent them from utilising the services provided by Jobstore.
12. IDENTIFIERS
12.1
Jobstore will not adopt, use or disclose identifiers assigned by the Government, such as a tax file number, Medicare number or provider number, for its own purposes, unless one of the exemptions in the Privacy Act applies.
13. ACCURACY OF PERSONAL INFORMATION
13.1
Jobstore is committed to ensuring that the personal information it collects, uses and discloses is relevant, accurate, complete and up-to-date. Jobstore encourages Individuals to contact Jobstore to update any personal information it holds about an Individual. If Jobstore corrects information that has previously been disclosed to another entity, Jobstore will notify the other entity within a reasonable period of the correction. Where Jobstore is satisfied information is inaccurate, it will take reasonable steps to correct the information within 30 days, unless the Individual agrees otherwise. Jobstore does not charge the Individual for correcting the information.
14. ACCESS TO PERSONAL INFORMATION
14.1
Subject to the exceptions set out in the Privacy Act, Individuals may gain access to the personal information that Jobstore holds about them by contacting the Jobstore Privacy Officer. If it is reasonable and practicable to do so, Jobstore will provide access to the information within 30 days of receipt of the Individual's request. If Jobstore refuses to provide the information, it will provide reasons for the refusal and identify the mechanisms available to the Individual to complain about the refusal.
14.2
Jobstore will require identity verification and specification of what information is required. An administrative fee for search and photocopying costs may be charged for providing access.
15. CHANGES TO PRIVACY POLICY
15.1
This Policy will be reviewed from time to time to take account of new laws and technology, and changes to Jobstore's operations and the business environment. Any changes to this Policy can only be approved by Directors or Management. Upon any amendments to the Privacy Policy, Jobstore shall update the Website and notify Users accordingly within a reasonable period.
16. RESPONSIBILITIES
16.1
It is the responsibility of management to inform employees and other relevant third parties about the Jobstore Privacy Policy. Management must ensure that they advise Jobstore's employees and other relevant third parties of any changes to the Privacy Policy.
16.2
It is the responsibility of all employees and other relevant parties to ensure that they understand and comply with this Privacy Policy.
16.3
All new employees are provided with timely and appropriate access to Jobstore's Privacy Policy. All employees are provided with opportunities to attend privacy training, which covers Jobstore's obligations under the Privacy Act, the APPs and NDB scheme. Employees must ensure that they understand the Privacy related issues that could adversely affect Jobstore and the Users if not properly adhered to.
17. NON-COMPLIANCE AND DISCIPLINARY ACTIONS
17.1
Actual or suspected privacy breaches must be immediately reported to management by employees and relevant third parties. Ignorance of the Jobstore Privacy Policy will not be an acceptable excuse for non-compliance. Employees or other relevant third parties that do not comply with Jobstore's Privacy Policy may be subject to disciplinary action.
18. CONTRACTUAL ARRANGEMENTS WITH THIRD PARTIES
18.1
Jobstore may disclose personal information to third party service providers in connection with the services provided by Jobstore on the Website, in accordance with this section.
18.2
Jobstore must ensure that all contractual arrangements with third parties adequately address privacy issues. Jobstore will make third parties aware of this Privacy Policy.
18.3
Third parties will be required to implement policies in relation to the management of an individual's personal information in accordance with the Privacy Act. These policies include:
18.3.1
regulating the collection, use and disclosure of personal and sensitive information;
18.2.2
de-identifying personal and sensitive information wherever possible;
18.2.3
ensuring that personal and sensitive information is kept securely, with access to it only by authorised employees and agents of the third parties; and
18.2.4
ensuring that the personal information is only disclosed to organisations which are approved by Jobstore.
19. GOVERNING LAW AND JURISDICTION
The Privacy Policy shall be governed by and in accordance with the laws of Australia.
20. INQUIRIES AND COMPLAINTS
20.1
Jobstore has an effective complaints handling process in place to manage privacy risks and issues.
20.2
An Individual can make a complaint to Jobstore about the treatment or handling of their personal information by lodging a complaint with the Privacy Officer in any of the following ways:

helping to build and preserve Jobstore's reputation and business.
